HOUSE RESOLUTION NO. 7

Requesting the director of the division of natural resources to designate one or more streams or sections of streams in West Virginia as "weekend fishing only" streams.

Whereas, Chapter twenty of the West Virginia code was enacted by the Legislature to provide a comprehensive program for the exploration, development, protection, enjoyment and use of the natural resources of the State, including its streams and fish in its streams; and

Whereas, The office of the division of natural resources was created by the Legislature, with jurisdiction, powers, functions, services and enforcement processes as provided by law, including the authorization and empowerment to prescribe the locality in which and the method and manner by which various species of wildlife, including fish, may be taken; and
Whereas, The House of Delegates of the 71st Legislature of West Virginia, 1994, is concerned that the weekday usage of certain fishing streams in West Virginia is such that those residents and nonresidents of the State who are unable to fish such streams during the weekday are unable to fully enjoy the development efforts undertaken by the State in stocking and maintaining certain streams; therefore, be it
Resolved by the House of Delegates:
That the director of the division of natural resources is hereby requested, pursuant to his authority under the provisions of chapter twenty of the State code, to designate one or more streams or sections of streams in West Virginia as "weekend fishing only" streams, in order to limit fishing of such streams to legal holidays and Saturdays and Sundays only, with such designation to be effective for at least a one-year period from the time of such designation; and, be it
Further Resolved, That the director of the division of natural resources is hereby requested, after such one-year period, to prepare a report for presentation to the House Committee on Agriculture and Natural Resources during the regular session of the Legislature, 1996, relating to the director's findings, conclusions and recommendations relating to the impact of such designation upon such streams and the fishing thereof, together with a draft of any legislation necessary to effectuate the director's recommendations, if any, for the continuation of such designation(s) by enactment of specific legislation; and, be it
Further Resolved, That the Clerk of the House of Delegates is hereby directed to forward a copy of this resolution to the director of the division of natural resources.
